Terms and Conditions

1. Definitions

1.1 These conditions govern all agreements for the sale of Goods by Us to You, excluding any other terms or conditions that You may attempt to apply via purchase orders or other correspondence.

  • “We,” “Us,” “Our” refers to Cornerstone, Brims Park, Old Callywith Road, Bodmin PL31 2DZ
  • “You,” “Your” refers to the business or entity purchasing Goods from Us.
  • “Goods” means any materials and products supplied by Us under these terms.
  • “Services” refers to product processing, transportation, training, consultation, product testing, or advisory services provided by Us upon request, either invoiced or complimentary.
  • “Contract” means the agreement governing the supply of Goods and Services, incorporating these Terms.

2. Liability & Warranty

2.1 We are not liable for any loss resulting from representations made by Us or Our employees, except those explicitly stated in this agreement.

2.2 If a valid claim is received, We may replace the Goods at no cost or, at Our discretion, provide a refund or partial reimbursement, with no further liability.

2.3 Any claims regarding defective Goods must be submitted in writing within 10 days of the issue becoming apparent.

2.4 We may request the return of the Goods or require access to inspect them in situ. Claims may be rejected if these requests are denied.

2.5 We are not liable for defects caused by wear and tear, improper use, negligence, alterations, failure to follow relevant British Standards or industry guidelines, or inadequate storage conditions.

2.6 No liability is assumed for defects identified upon reasonable inspection at delivery, or if the Goods were knowingly used despite identified defects.

2.7 We are not responsible for defects in Goods manufactured or processed to Your specifications where the issue stems from Your provided formulation, materials, or instructions.

2.8 Limitation of Liability: All warranties, conditions, and implied terms (except those under Section 12 of the Sale of Goods Act 1979) are excluded to the fullest extent permitted by law. Our liability is capped at the contract price. We are not responsible for indirect or consequential losses, including economic loss, profit depletion, or reputational damage arising from or related to the Contract.

3. Terms of Trade

3.1 Unless specific credit terms have been agreed, goods will not be dispatched until full payment has been received.

3.2 If agreed credit terms are breached, We may:

  • Suspend trade and pending orders.
  • Apply statutory interest on outstanding balances at 8% plus the Bank of England base rate.
  • Invoice and hold Goods until payment is received in full.

3.3 You remain liable for all delivered Goods and Services performed, whether invoiced or not.

4. Pricing

4.1 All prices are exclusive of VAT, charged at the applicable rate at the time of invoicing. Prices may be adjusted before delivery to reflect external cost increases beyond Our control (e.g., transportation costs).

5. Title & Ownership

5.1 Goods remain Our property until full payment is received. You grant Us an irrevocable license to enter Your premises and retrieve unpaid Goods if payment terms are breached or Your possession rights are terminated.

6. Order Cancellation & Returns

6.1 You must notify us within 14 days of receiving Your Goods if You wish to cancel or return an order.

6.2 If Your order is already in transit, cancellation is no longer possible. However, once the items are received, You may request a return or exchange within 14 days.

6.3 Returned items must reach Us within 14 days of notifying Us about Your intention to cancel or return.

6.4 Some returns may be subject to a 10% handling fee. Refunds or account credits will be processed within 14 days of receiving the returned items. Returns will only be accepted from the original purchaser.

6.5 Returns or exchanges of unopened and undamaged items in resalable condition are permitted within 14 days from the date of purchase (for in-store transactions) or the date of delivery (for online orders) with valid proof of purchase.

Non-Returnable Items

Unless faulty, the following cannot be exchanged, returned, or cancelled: Perishable, made-to-order, or custom-made items. This includes:

  • Items cut to size (e.g., mesh or hessian)
  • Ready-mixed mortars, renders, plasters, or grouts
  • Lime, cement, or gypsum-based binders
  • White-label, bespoke, or custom-made products (e.g., custom-matched paints, mortars, renders, or plasters)
  • Items that become inseparably mixed with other materials after delivery

If You have questions about a potential return, contact Our team before proceeding.

6.6 Returned items remain Your responsibility until they reach Us, so ensure proper packaging and obtain proof of postage.

6.7 Insufficient packaging may reduce Your refund if the item’s condition is affected. You are responsible for covering postage or delivery fees for returns and exchanges.

7. Delivery Terms & Conditions

7.1 Safety & Access Requirements

7.1.1 You must ensure that the delivery site is safe and suitable for heavy goods transportation.

7.1.2 Adequate access must be available for delivery vehicles, including space for manoeuvring and unloading. Delivery dimensions are provided in Our delivery information page.

7.1.3 You must inform Cornerstone of any potential hazards or considerations regarding the delivery site.

7.2 Liability for Accidental Damage

7.2.1 While Cornerstone takes precautions to prevent accidental damage, We are not liable for damage caused by inadequate or unsuitable access conditions.

7.2.2 The customer must ensure the delivery path is clear and suitable for heavy goods vehicles, considering factors such as:

  • Manhole/drain covers, underground services, pathways, or edging
  • Surface finishes that could be affected by heavy goods vehicles Requesting delivery off the public highway absolves Cornerstone of any liability regarding damage.

7.3 Assumptions & Responsibilities

7.3.1 Unless informed otherwise, Cornerstone assumes the delivery site meets safety and access requirements.

7.3.2 Customers must provide clear instructions regarding site access requirements, acknowledging that HGVs are used for delivery.

7.3.3 Failure to notify Us of access issues may result in postponed delivery, additional fees, or non-delivery.

7.4 Delivery Process

7.4.1 The delivery team will conduct a basic visual assessment before unloading. However, customers must disclose any hidden site risks.

7.4.2 If a site is deemed unsafe or unsuitable, delivery may be rescheduled, and additional charges may apply. If an alternative drop-off point is agreed, the responsibility falls on the customer, and reattempting delivery will incur fees.

7.4.3 Excessive waiting time for access may result in a discretionary charge.

7.5 Health & Safety Compliance

7.5.1 Cornerstone complies with health & safety regulations and expects the same from customers and site managers.

7.5.2 Breaches of health & safety regulations may lead to postponement or cancellation, with costs borne by the customer.

7.6 Delivery Procedures

7.6.1 Delivery charges will be clearly displayed on invoices.

7.6.2 Delivery times are estimates and do not form part of the contractual agreement.

7.6.3 If You request delivery in Your absence, you accept full responsibility once delivery takes place.

7.6.4 If delivery is attempted and You are not present, the Goods will return to the depot, and a redelivery charge may apply.

7.6.5 Inspect Your order upon delivery before signing. Report any damage immediately and document any issues on the courier’s device or paperwork.

7.6.6 Risk transfers to the customer upon receipt of Goods.

7.6.7 If a purchased item is faulty, you may request a repair, exchange, or refund as per Your consumer rights.

7.6.8 Any defect-related claims must be submitted within 48 hours of delivery, or Goods will be deemed accepted.

8. Missing Items

8.1 Please notify Us within three days of delivery if any items are missing.

9. Pallet Deliveries & HGVs

9.1 Pallet orders are delivered by third-party couriers using Heavy Goods Vehicles (HGVs).

9.2 Customers must ensure sufficient access for HGVs at their location.

9.3 If access is limited, notify Cornerstone and any third-party couriers.

9.4 Ensure the drop-off point is level, stable, and unobstructed.

9.5 Third-party deliveries are kerbside only, with no access to private roads or tracks.

9.6 Drivers are not obligated to reposition pallets upon delivery.

9.7 If delivery cannot proceed due to unsuitable conditions, the order may be returned, with redelivery charges applying.

10. Colour Variance

10.1 Colours displayed online or in print are indicative only.

10.2 Digital screens or printed materials may not accurately reflect colours.

10.3 To ensure accuracy, we recommend purchasing a sample pot before final selection.

10.4 Natural products may exhibit batch variations in colour, texture, and consistency.

10.5 If consistency is crucial, we recommend completing each elevation using materials from the same batch.

11. Technical Information, Quotations & Estimates

11.1 All material quantities required for Your project depend on site conditions and practices. We provide only consumption guidelines rather than precise quantities.

11.2 You are responsible for determining the quantities needed and confirming that the Goods are suitable for Your intended use. Any estimates or advice regarding the suitability of Goods provided by Us are non-binding and offered without liability. By placing an order, You confirm that You do not rely on any representations made by Us.

12. Worksite Safety

12.1 We strongly recommend adhering to safe workplace practices and following all hazard and precautionary statements provided with Our Goods.

12.2 Customers must always use appropriate Personal Protective Equipment (PPE) when handling or working with Our Goods. Additional safety guidance is available upon request.

13. Advice & Information

13.1 Any information provided by Cornerstone, whether through Our Knowledgebase, website, or printed materials, is for informational purposes only and does not constitute a formal specification.

13.2 Use of Our materials and reliance on any information provided is solely at Your own risk.

13.3 Every project is unique. We strongly advise consulting a professional before undertaking any work.
